Terms of Service

1. Acceptance of Terms

By accessing and using Podiia ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Podiia provides event management software that enables organisers to create, manage, and promote events. Features include RSVP management, ticketing, QR code check-in, attendee approval workflows, and programme scheduling.

3. User Accounts

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You must provide accurate and complete information when creating an account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to: (a) violate any applicable laws or regulations; (b) infringe upon the rights of others; (c) distribute spam, malware, or harmful content; (d) impersonate any person or entity; (e) interfere with or disrupt the Service or servers; (f) attempt to gain unauthorized access to any portion of the Service.

5. Content Ownership

You retain all rights to the content you create and upload to the Service (event descriptions, images, attendee data, etc.). By using the Service, you grant us a limited license to host, store, and display your content as necessary to provide the Service.

6. Data and Privacy

We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws, including GDPR. All data is stored in the EU (Frankfurt region). You are responsible for obtaining necessary consents from your event attendees for data processing.

7. Payment Terms

Fees are agreed individually per client and invoiced according to the terms set out in your service agreement. All fees are non-refundable except as required by law. We reserve the right to adjust fees with 30 days' notice. Failure to pay may result in suspension or termination of your account.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime or service interruptions.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

10. Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your access to the Service if you violate these Terms or engage in conduct that we deem harmful to the Service or other users. Upon termination, you may export your data within 30 days, after which it will be permanently deleted.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of Germany. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.
